            A.  Approval of Minutes September 7, 2010

 

RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Minutes of the September 7, 2010 Regular Meeting as presented.  

           

B. Approval of Voucher Detail Report

 

RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Voucher Detail Report dated September 21, 2010 in the amount of $___________

 

C.  Fire Department – Appointment – Ossining Fire Police & Emergency      Squad Inc.        

 

RESOLVED,  that upon the recommendation of the Fire Chief, Steven Dewey  Ossining, NY, was elected an active member of Ossining Fire Police & Emergency Squad Inc., for exterior firefighting at their regular meeting held on September 2, 2010.

 

            D. Fire Department-Appointment-Independent Hose Company, No. 6

 

RESOLVED,  that upon the recommendation of the Fire Chief, Andrew Sacchi  Ossining, NY, was elected an active member of Independent Hose Company, No. 6, for exterior firefighting at their regular meeting held on July 1, 2010.

 

E.  Fire Department-Appointment-Washington Hook & Ladder Company, No. 2

 

RESOLVED, that upon the recommendation of the Fire Chief, Steven White Ossining, NY, was elected an active member of Washington Hook & Ladder Company, No. 2, for interior firefighting at their regular meeting held on

            August 2, 2010.

 

F. Authorization to Apply for a Grant for Historic Walking Tour - NYS Office of Parks, Recreation and Historic Preservation - Certified Local Government Grant – Software

 

WHEREAS, the Village of Ossining contains numerous structures and sites of historic, cultural, and architectural importance within the downtown Crescent area;

 

WHEREAS, the creation of self-guided historic walking tour materials for the Crescent area consisting of maps and brochures detailing the location of significance of historic sites and structures will allow Village residents and visitors to gain insight into the role that these locations have served in the development of the community and the role that they continue to serve today;

 

WHEREAS, the creation of the aforementioned self-guided tour will require Village personnel to utilize specialized software to draft, edit, and publish the tour materials;

 

WHEREAS, the New York State Office of Parks, Recreation, and Historic Preservation has made available monies to fund such historic preservation-themed initiatives for local governments that have achieved a Certified Local Government designation; now therefore be it

 

RESOLVED, That Richard Leins, as Village Manager of the Village of Ossining or such person’s successor in office is hereby authorized and directed to file an application for funds from the Certified Local Government Grant program in an amount not to exceed $700.00 and upon approval to enter and execute an agreement with the New York State Office of Parks, Recreation, and Historic Preservation for such financial assistance to the Village for the purchase of desktop publishing software to facilitate the creation of historic walking tour materials by Village personnel.

 

G.  Acceptance of Grant for Historic Walking Tour - NYS Office of Parks, Recreation and Historic Preservation - Certified Local Government Grant - Software

 

WHEREAS, the Village of Ossining has received and accepts $671.00 in financial assistance from NYSOPRHP to fund the acquisition of software for the Historic Walking Tour project; now therefore be it

 

RESOLVED, that the Village Manager is hereby authorized to act on behalf of the Village Board of Trustees in all matters relating to this financial assistance and is hereby directed to enter and execute an agreement(s) for such financial assistance as necessary to fulfill all conditions and requirements of the said financial assistance.

 

H.  Authorization to Apply for a Grant for Historic Walking Tour - NYS Office of Parks, Recreation and Historic Preservation - Certified Local Government Grant –Printing Costs

 

WHEREAS, the Village of Ossining contains numerous structures and sites of historic, cultural, and architectural importance within the downtown Crescent area;

 

WHEREAS, the creation of self-guided historic walking tour materials for the Crescent area consisting of maps and brochures detailing the location of significance of historic sites and structures will allow Village residents and visitors to gain insight into the role that these locations have served in the development of the community and the role that they continue to serve today;

 

WHEREAS, the dissemination of the materials for the aforementioned tour materials will require the expenditure of funds to cover the cost of printing the tour materials;

 

WHEREAS, the New York State Office of Parks, Recreation, and Historic Preservation has made available monies to fund such historic preservation-themed initiatives for local governments that have achieved a Certified Local Government designation; now therefore be it

 

RESOLVED, That Richard Leins, as Village Manager of the Village of Ossining or such person’s successor in office is hereby authorized and directed to file an application for funds from the Certified Local Government Grant program in an amount not to exceed $1,550 and upon approval to enter and execute an agreement with the New York State Office of Parks, Recreation, and Historic Preservation for such financial assistance to the Village for the cost of printing the maps and brochures that will constitute the self-guided tour materials.

 

I.  Surplus Equipment – Recreation Department - Sailboats

 

RESOLVED, that the Board of Trustees of the Village of Ossining hereby declares the one (1) 1965 19 foot O'Day Mariner Sailboat and one (1) 1967 22 foot O'Day Tempest Sailboat as surplus equipment to be sold as is.

 

J. Design Work - Riverwalk – RGR Landscape Architecture

 

WHEREAS, the Village of Ossining received a 2007 EPF LWRP grant for Westchester RiverWalk at Edward M. Wheeler Crawbuckie Nature Area contract C006855; and

 

WHEREAS, as part of said contract the Village of Ossining sent out Request for Proposals for the design work in accordance with said contract; and

 

WHEREAS, three proposals were received by Munz Associates Architecture and Landscape Architecture, PLLC of 26 Hoyt Street South Salem, NY,  Barreto/Dowd Landscape Architecture Site Planning 100 Tavern Road Hopewell, NJ and RGR Landscape Architecture 115 Fifth Avenue New York, NY and

 

WHEREAS, the Village Board of Trustees finds the RGR Landscape Architecture to have the most relevant professional experience that relates to the work required the Edward M. Wheeler Crawbuckie Nature Area; now therefore be it

 

RESOLVED, that the Village of Ossining hereby accepts the submitted proposal from RGR Landscape Architecture, 115 Fifth Avenue, New York, NY and the Village Manager is directed to execute a contract with said consultant.  

 

K. Riverwalk Trailway – License Agreement

 

RESOLVED, that the Board of Trustees hereby authorizes the Village Manager to enter into a License Agreement with the County of Westchester for the purpose of designing the “Riverwalk” Trailway, a public recreation corridor for bicycles and pedestrians, for the period of two years from the date of said agreement, unless sooner terminated as provided in the agreement.  This agreement pertains to land parcels 89.14-1-2, 89.10-1-11, 89.10-1-12, 89.14-1-9, and 89.14-1-14.

 

L. Acceptance of NYSERDA Grant – Air Handler at Joseph G. Caputo Community Center

 

WHEREAS, the Village of Ossining received and accepts $81,000 financial assistance from NYSERDA that is funded from the American Recovery and Reinvestment Act of 2009 for the Joseph G. Caputo Community Center air handler replacements and system upgrades; now therefore be it

 

RESOLVED, that the Village Manager is hereby authorized to act on behalf of the Village Board of Trustees in all matters relating to this financial assistance and is hereby directed to enter and execute an agreement(s) for such financial assistance and energy conservation study as necessary to fulfill all conditions and requirements of the said financial assistance.

 

M.  Finance – Budget Modification – Caputo Recreation Center Air Handlers Capital Project

 

WHEREAS, the NYS Energy Research and Development Authority (NYSERDA) has awarded the Village a grant in the amount of $81,000 to replace the air handlers and add new control systems at the Joseph G. Caputo Community Center, and

 

WHEREAS, the Village’s local share grant match plus design and bid work is estimated to be $9,000 and $7,000, respectively ($16,000 total), to be financed from the Village’s General Fund Contingency Account, and

 

WHEREAS, the Board of Trustees wishes to establish a capital project budget for the Caputo Center Air Handlers Capital Project, now therefore be it

 

RESOLVED, the Board of Trustees accepts the aforesaid NYSERDA Grant in the amount of $81,000, and authorizes the transfer of $16,000 from the General Fund Contingency Account for the Caputo Center Air Handlers Capital Project, and be it further

 

RESOLVED, the 2010 Adopted Budget is modified, and a Capital Project budget is established, as follows:

N. Resolution Regarding Special Permit – Avalon  - Planning Board Referral 

 

WHEREAS, AvalonBay Communities, Inc. has submitted an application to the Village requesting an (i) an amendment to the Zoning Map of the Village to re-zone the property commonly known as 217 North Highland Avenue from OR Office Research District to CDD Conservation Development District and (ii) site plan approval for the development at the property of a proposed mixed-use community having 168 residential units and approximately 14,400 square feet of office space in accordance with Section 270-23 I of the Zoning Law of the Village of Ossining, in connection with its property located at 217 North Highland Avenue; and  

 

WHEREAS, Article XI of the Zoning Law provides that the Planning Board shall review any such application and transmit its recommendations and report in connection with same to the Village Board;  

 

NOW, THEREFORE BE IT, RESOLVED, that the application of AvalonBay Communities, Inc. for (i) an amendment to the Zoning Map of the Village to re-zone the property commonly known as 217 North Highland Avenue from OR Office Research District to CDD Conservation Development District and (ii) site plan approval for the development at the property of a proposed mixed-use community having 168 residential units and approximately 14,400 square feet of office space, be and it is hereby referred to the Planning Board for its recommendations and report in connection therewith.
