I. CALL TO ORDER

The Regular Meeting of the Board of Trustees was held in the Joseph G. Caputo Community Center, 95 Broadway, Ossining, New York. The meeting was called to order at 7:30 P.M. by Mayor John Perillo. Members of the Board present were Trustee Napolitano, Trustee Parise and Trustee Hernandez. Trustee MacNeill was absent. Others present were Village Corporation Counsel Richard Liens, Village Manager Lynn McCrum, Police Chief Joseph Burton, Administrative Intern Christina Papes and Village Clerk Mary Ann Roberts.

II. MAYOR'S ANNOUNCEMENTS

The Mayor announced that this evenings Village Board Meeting is abbreviated without Visitor Recognition or Employees of Distinction.

III. VILLAGE BOARD LIAISON REPORTS

No Reports

IV. ADMINISTRATIVE REPORTS

1. Village Manager Lynn McCrum, announced the 2004 Budget was presented to the Board by the Village Manager.

2. Police Chief Joseph Burton, announced that the Civilian Student Police Academy begins on November 19th. Youth Officer John Giralamo was awarded the Rotary Employee of the Year on Monday evening.

3. Corporation Counsel, Richard Leins, stated that the Tax Office was sending out final warning letters in the in-rem.

V. VILLAGE BOARD RESOLUTIONS

A. Approval of Minutes October 21, 2003 Regular Meeting

Trustee Hernandez moved and it was seconded by Trustee Napolitano that the following resolution be adopted:

RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Minutes of the October 21, 2003 regular meeting as presented.

Motion Carried: Unanimously

B. Voucher Detail - November 6, 2003

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Voucher Detail dated November 6, 2003 in the amount of $ 791,503.91.

Motion Carried: Unanimously

C. Resolution - NYS Snow and Ice Agreement - 2004 -2005

Trustee Hernandez moved and it was seconded by Trustee Napolitano that the following resolution be adopted:

RESOLVED, that the Board of Trustees of the Village of Ossining hereby authorizes the Village Manager to sign an agreement with the New York State Department of Transportation to extend the current indexed Lump Sum Snow and Ice Agreement for a period of one year, commencing on July 1, 2004 to expire on June 30, 2005.

Motion Carried: Unanimously

D. Resolution - NYS Snow and Ice Agreement - 2005 -2006

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

RESOLVED, that the Board of Trustees of the Village of Ossining hereby authorizes the Village Manager to sign an agreement with the New York State Department of Transportation to extend the indexed Lump Sum Snow and Ice Agreement for a period of one year, commencing on July 1, 2005 to expire on June 30, 2006.

Motion Carried: Unanimously

E. Resolution - Yard Waste Transfer Site - IMA - Town of Ossining

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

RESOLVED, That the Village Manager is authorized to enter into an Inter-municipal agreement with the Town of Ossining for use of the Village of Ossining’s transfer site for organic waste, at a charge of $18 per ton for collected yard waste. This agreement shall be effective immediately and shall expire June 30, 2004.

Motion Carried: Unanimously

F. Resolution - Yard Waste Transfer Site - IMA - Village of Croton-on-Hudson

Trustee Hernandez moved and it was seconded by Trustee Napolitano that the following resolution be adopted:

RESOLVED, That the Village Manager is authorized to enter into an Inter-municipal agreement with the Village of Croton-on-Hudson for use of the Village of Ossining’s transfer site for organic waste, at a charge of $18 per ton for collected yard waste. This agreement shall be effective immediately and shall expire June 30, 2004.

Motion Carried: Unanimously

G. Resolution - Bennett Kielson Storch & Co.

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

RESOLVED, that the Village Manager is hereby authorized to enter into an agreement with Bennett Kielson Storch DeSantis, One Barker Avenue, White Plains, New York 10601-1503 for auditing of the basic financial statements of the Village of Ossining for the years ending December 31, 2003, 2004, 2005, 2006 and 2007 in accordance with the fees outlined in their proposal dated October 8, 2003.

Motion Carried: Unanimously

H. Resolution - Hawkes Ave. Fire Station - Saccardi & Schiff, Inc.

Trustee Napolitano moved and it was seconded by Trustee Parise that the following resolution be adopted:

RESOLVED, that the Village Manager is hereby authorized to enter into an agreement with Saccardi & Schiff Inc., 245 Main Street, White Plains, New York 10601 to review the potential environmental issues and for the preparation of a full Environmental Assessment form as it relates to the Town of Ossining’s proposed zoning to allow firehouses in residential areas, in accordance with the proposal dated October 28, 2003, for an amount not to exceed $6,000.00.

Motion Carried: Unanimously

I. Call for Public Hearing - Tentative Budget 2004

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing in the matter of the 2004 Tentative Village Budget to be held November 18, 2004 at 7:30 P.M. in the Police Court Facility, 86-88 Spring Street, Ossining, New York 10562.

Motion Carried: Unanimously

J. Call for Public Hearing - Introductory Local Law No. 9, 2003, Railroad Station Bridge Stopping.

Trustee Hernandez moved and it was seconded by Trustee Parise that the following resolution be adopted:

INTRODUCTORY LOCAL LAW NO. 9, 2003

A LOCAL LAW amending Chapter 250 of the Village Code of the Village of Ossining entitled, "Vehicles and Traffic", Article VI, "Schedules", Section 250-49 Schedule XII: "Parking Prohibited at All Times", Section 250-50 Schedule XIII: "No Stopping", Section 250-52 Schedule XV: "Parking Prohibited Certain Hours" and Section 250-53 Schedule XVI: "No Stopping Certain Hours".

BE IT ENACTED by the Board of Trustees of the Village of Ossining, as follows:

Section 1. Chapter 250 of the Village Code of the Village of Ossining entitled, "Vehicles and Traffic", Article VI, "Schedules", Section 250-49 Schedule XII: "Parking Prohibited at All Terms" is hereby amended as follows, with new matter underlined, and matter to be deleted in [brackets]:

Section 250-49. Schedule XII: Parking Prohibited at All Times.

In accordance with the provisions of Section 250-16, no person shall park a vehicle at any time upon any of the following described streets or parts thereof:

Section 2. Chapter 250 of the Village Code of the Village of Ossining entitled, "Vehicles and Traffic", Article VI, "Schedules", Section 250-50 Schedule XII: "No Stopping" is hereby amended as follows, with new matter underlined:

Section 250-50. Schedule XIII: No Stopping.

In accordance with the provisions of Section 250-17, no person shall stop a vehicle at any time upon any of the following streets or parts thereof:

Section 3. Chapter 250 of the Village Code of the Village of Ossining entitled, "Vehicles and Traffic", Article VI, Schedules, Section 250-52, Schedule XV: "Parking Prohibited Certain Hours" is hereby amended as follows:

Section 250-52. Schedule XV: Parking Prohibited Certain Hours.

In accordance with the provisions of Section 250-19, no person shall park a vehicle between the times specified upon any of the following described streets or parts thereof:

Section 5. Except as herein modified all other portions of Chapter 250 shall remain the same.

Section 6. This Local Law shall take effect immediately upon publishing and posting as required by law.

K. Fire Department - Appointment - Independent Hose Company, No. 6.

Trustee Napolitano moved and it was seconded by Trustee Hernandez that the following resolution be adopted:

 

RESOLVED, that upon recommendation of the Fire Chief, Angelo Indusi, 109 Spring Valley Road, Ossining, New York was elected to active membership of the Independent Hose Company, No. 6 at their monthly meeting held on September 4, 2003 and was approved for interior and exterior fire fighting.

VI. OLD BUSINESS OF THE BOARD

There was no old business

VII. NEW BUSINESS OF THE BOARD

Trustee Parise questioned whether there was a new garbage truck in service. He also questioned the red light at the Junction of 133 and 9.

Trustee Hernandez questioned the status of the Peekskill dumping issue. The County has gotten involved and is voiding the tickets. The Village did purchase the Peekskill Permits

VIII. ADJOURNMENT

At 7:51 P.M., Mayor Perillo moved and it was seconded by Trustee Hernandez that the regular meeting be adjourned in memory of Gilda Consaga of Havell Street, a true resident. The Board would then go into Executive Session for the purpose of discussing Litigation.
