    Update on Revisions to Village Code Regarding Property Maintenance and Inspection and Local Code Enforcement


     

    STREAMLINING THE LAND DEVELOPMENT APPROVAL PROCESS IN THE VILLAGE OF OSSINING – FINAL REPORT


    REMINDER TO ALL LANDLORDS....Building temperature must be maintained to at least 68 degrees (24 hrs. a day) from September 15 to May 31. 
     

    **PLEASE BE ADVISED**

     
    As per Title 19 Part 1203 of the New York State Uniform Code requires Operating permits to be issued for the following businesses conducting the following activities or using the categories of buildings listed below;

    1) Manufacturing, storing or handling hazardous materials in quantities exceeding those listed in Tables 2703.1.1(1), 2703.1.1(2), 2703.1.1(3) or 2703.1.1(4), of the Fire Code of New York State.
     
    2)  Hazardous processes and activities, including but not limited to, commercial and industrial operations which produce combustible dust as a byproduct, fruit and crop ripening, and waste handling.
     
    3) Use of pyrotechnic devices in assembly occupancies.
    4) Buildings containing one or more areas of public assembly with an occupant load of 100 persons or more.
     
    5) Buildings whose use or occupancy classification may pose a substantial potential hazard to public safety, as determined by the government or agency charged with or accountable for administration and enforcement of the Uniform Code.
     
    The Village of Ossining will be sending out notices to those businesses and/or buildings that are fall into any category described above. When you receive the notice, please contact our office as soon as possible to schedule a fire inspection which is required to obtain the permit. Permits are issued on a yearly basis and there is a charged annual fee of $100. An attached  downloadable permit application has been provided, see link above.
     

     

     

    **Sign / Awning Permits**

     

    • Permits are required for the installation of signs including facades, free standing, flag, window, awning and home based business signs in a residential districts.
    • Temporary signs are permitted twice a year for a maximum of thirty days each which promotes ones business. Any sign Installation in a historic district require Historic Preservation Commission Approval.
    • Installation of awnings over the Village right of way requires Board of Trustee Approval.



    BUILDING DEPARTMENT

    The Department of Building is responsible for the Enforcement of the Local Ordinances of the Village of Ossining (and all applicable County and State Laws). These laws regulate the use and occupancy of private land and structures for the purpose of securing the public safety, health and general welfare through structural strength, stability, means of egress, adequate light and ventilation, and safety to life and property from fire and other hazards. This is accomplished by the building department following certain procedures which include:

                          Processing of Building, Electric, Plumbing, Tree, and Demolition permit 
                           applications and
     Certificates of Occupancy.                                      

                          Plan review

                          Building inspections

                          Construction code enforcement

                          Backflow prevention program

     

    The department coordinates its programs with other departments and agencies of the Village, County and State governments, and also with private agencies that have similar responsibilities, including among others, the New York Board of Fire Underwriters, the American Standards Association, the American Society for Testing and Materials, the National Fire Protection Association and Underwriters Laboratories.

    ENFORCEMENT:

    Village ordinances and inspections enforced by the Department include, but are not limited to, the Village of Ossining Zoning Ordinance, the Outdoor Signs and Awnings Ordinance, fire inspections, housing code, Section-8 inspections, parking inspections and sanitation code.  State Laws enforced include the Building Code, Residential Code, Fire Code, Property Maintenance Code, Mechanical Code, Fuel Gas Code and the Energy Conservation code.  The Village of Ossining is an active participant in the New York State Building Officials Conference. The Building Department will continue to help address the quality of life and safety issues that affect the Village of Ossining residents and property owners.
